Voici la réponse de Nexus, déjà diffusée sur la liste Yahoo et sur Tric Trac :
"I think that it would be appropriate that one should at the very
least wait to know what's going on, before airing such hot comments.
But unfortunately this seems to be the way of the Internet nowadays -
flame before you think.
We did not ask any PBEM to be canceled. This is the exact text of
what we asked for, just to state without any misunderstanding what we
have been asking, related to the announcement of the development of a
campaign system:
************************************
Dear Sirs
we've been notified of your activities (see below) regarding Wings of
War gaming on your web site.
While we are honored that you appreciate our game line, unfortunately
we can not endorse this activity, even if done for non commercial
use, as it makes use of our trademarks, game mechanics, and other
copyright-protected items.
We are currently in discussion with two different companies regarding
online gaming right for Wings of War, and this is a further concern,
as this activity may also be damaging the deals we are discussing.
If your company wishes to pursue a license for online gaming rights
to Wings of War, you should apply for a license with urgency (if you
want your offer to be taken into consideration before we finalize any
deal), submitting your proposal to my attention.
Else, we can not allow you to continue with the development of this
online gaming system.
Yours,
Roberto Di Meglio
Nexus Editrice srl, Director and CEO.
************************
So we did not ask to STOP any of the current activities. We asked not
to DEVELOP them at the point where they could be perceived as
an "online gaming system", damaging the license deals we're
discussing.
We are definitely ok with gaming activities which:
1) are E-mail based, rather than playable on-line in real time
2) make sure to advertise the copyright and trademark holders of the
contents they are using
3) are playable only by people who actually own a copy of the game
(that is, don't provide a full implementation of gaming components)
4) are not done for the purpose of profit.
Within these restrictions, we have no problem in Sim-gaming to
propose Wings of War as a PBEM game (or "Play by online form", it's
the same).
Wings of War is an important intellectual property for us, even if
we're no GW or Hasbro. We still have to do what it takes to make sure
that what we develop is protected from the point of view of copyright
protection.
This does not mean hampering anybody's capability of
playing the game if they own it, but also making sure that Wings of
War is not perceived as something that anybody may copy and use
freely and without our permission. If you are not active in
protecting your marks and copyright, they end up in the public
domain, and this is not what we want for Wings of War, as we are
planning to continue the development of this line in the years to
come.
Thanks to everybody who has been supportive to us.
Roberto Di Meglio"
Depuis, il semble qu'il n'y ait plus aucun obstacle et à la reprise du jeu par e-mail, et au développement du système souhaité par Henderson pourvu qu'il respecte les clauses posées par Nexus.
Tout est bien qui continue bien...
